STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:

(a) The Carrier is violating the Clerks' Agreement at Kilgore, Texas, by assigning work covered by the Clerks' Agreement to employes who are not covered by that Agreement. Also

(b) Claim that the Carrier be required to correct the Agreement violation by assigning the work here involved to employes holding seniority rights and working under the Clerks' Agreement. Also

(c) Claim that employes, covered by the Clerks' Agreement, at Kilgore be compensated on te same basis as they would have een had they been called to perform the work here involved.

FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and

That no hearing thereon has been held, and under date of July 7 1944, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.



Case dismissed.
