STATEMENT OF CLAIM: (1) Claim of the Order of Railway Conductors, Pullman System, for and in behalf of Mr. D. J. MacIsaac, formerly em. ployed as a conductor by The Pullman Company in the Chicago Eastern District, because The Pullman Company did, under date of October 30, 1943, discharge D. J. MacIsaac from the service on charges unproved and further because in discharging D. J. MacIsaac, The Pullman Company acted unjustly, and in abuse of its discretion and in violation of Rule 51 of the Agreement.
(2) Mr. D. J. MacIsaac shall now be restored to his former position as a conductor in the Chicago Eastern District with all rights unimpaired and shall be paid for all time lost by reason of said discharge.
That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and
That no hearing thereon has been held and under date of September 15, 1944, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.
