PARTIES TO DISPUTE:





STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on the Southern Pacific Company, Pacific Lines, that (1) under Rule 2 (b) of the effective agreement, the hourly rate for te position of Agent-telegrapher at Eloy, Tucson Division, should have been fixed at the same rate as position of Agent-telegrapher at Red Rock;


(2) That the rate for second and third telegraphers should have been fixed at 92¢ per hour;


(3) That such increases be effective as of February 17, 1942, the date on which operating change in conditions took place, and


(4) Employes who have occupied either of these positions since February 17, 1942 be retroactively reimbursed accordingly.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of December 15, 1944, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.




Case dismissed.
