PARTIES TO DISPUTE:





STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on the Southern Pacific Company, Pacific Lines:


1. That under Rule 2 (b) of the effective agreement, the hourly rate for the position of Agent-telegrapher at Higley, Tucson Division, should have been fixed at the time of establishment of position, at the same rate as position of Agent-telegrapher at Tovrea, a proper comparable station under the rules of the agreement;


2. That the Tovrea rate be now applied to Higley agency retroactively to the date of its establishment and employes who have occupied Higley be reimbursed accordingly.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of December 16, 1944, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.




Case dismissed.
