PARTIES TO DISPUTE:





STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on the Southern Pacific Company, Pacific Lines, that rental charges assessed against telegraphers at Hayden Junction, Arizona, be eliminated in compliance with Rule 37, Telegraphers' Agreement, and that all such rentals paid subsequent to the date of the inauguration of this claim, January 17, 1938, be refunded.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of December 15, 1944, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.




Case dismissed.
