STATEMENT OF CLAIM: Claim of the General Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes that:


(1) The memorandum of agreement covering employment of Student Clerical employes negotiated September 1, 1942 was terminated by the carrier December 18, 1942: that Carrier violated and continues to violate all rules of the current agreement, effective July 1, 1934, subsequent to date of termination of memorandum agreement above cited,


(2) That Wanda Lindley, Gertrude Ryan, Beverly Kirk, Ruth Reynolds, Mina Hogan and all other employes of the South-Central District, Union Pacific Railroad Co., who have been carried on payrolls, classified as student clerks, and paid student rate of $128.00 per month, subsequent to December 18, 142, shall be paid the difference between the student rate and the rate of position occupied in accordance with Rules 25 (a), (b), and 27 of the current agreement, effective July 1, 1934.


(3) That all employes classified as student clerks as of December 18 1942 established seniority as of that date, and all employes hired as student clerks subsequent to December 18, 1942, established seniority at the time their pay started, in accordance with Rule 2.

FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon. has been held but not concluded. Under date of December 21, 1944, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.



Case dismissed.
