STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that the Carrier violates the Clerks' Current Agreement when it fails and refuses to compensate Janitors and Elevator Operators at the General Office Building, Chicago, Illinois, at the time and one-half rate of pay for work performed on Sundays; and


(a) That Employes, Henderson Baker, Nick Kozick, Roman Ceglarz and all other Janitors or Elevator Operators at the General Office Building, Chicago, Illinois, be compensated at the rate of time and one-half for all Sunday work performed, retroactive to October 20, 1941, the date claim was filed with the Carrier.


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the Carrier and the Employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of January 4, 1945, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
