STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on the Delaware, Lackawanna and Western Railroad:


(a) That Produce Exchange telegraph office, New York, N. Y., having been continuously allocated to the Morris & E4sex Division since the telegraphers' agreement effective February 15, 1925, that Mary McElroy, employed in that office, shall be shown on the Morris & Essex Division seniority roster as of the date she entered the service as a telegrapher.


(b) That "PO" telegraph office, 140 Cedar Street, New York, N. Y., having been allocated to the Morris & Essex Division since the current telegraphers' agreement effective May 1, 1940, that Telegrapher E. H. Martin, employed in that office, shall be shown on the Morris & Essex Division seniority roster as of the date he entered the service as a telegrapher.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of January 15, 1945, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.




Case dismissed.
