PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:


(a) Carrier has violated and continues to violate the rules of the Clerks' Agreement when it declined and continues to decline, to increase the rate of pay of Mr. C. A. Johnson, and/or his successors, on position of Head Car Order and Diversion Clerk, San Francisco Freight Station, from $7.43 per day to $8.21 per day.


(b) Carrier be required to increase the rate of pay of position of Head Car Order and Diversion Clerk, San Francisco Freight Station, from $7.43 per day to $8.21 per day, retroactive to August 10, 1943, the date claim was initially filed by our Division Chairman with Carrier's Division Superintendent.


NOTE: The rates named in Items (a) and (b) above are subject to adjustment in consonance with the general wage increase award, dated Washington, D. C., January 17, 1944.

FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of January 26, 1945, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is-hereby granted.




Case dismissed.
