PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that the carrier violated the rules of the Clerks' Agreement at Cleveland, Ohio, when it assigned position of Chief Clerk to employe whose application was not received until after time limits specified in Bulletin No. 896 of March 17, 1944 had expired, and


That Carrier shall now assign position of Chief Clerk to General Yardmaster at Cleveland, Ohio to Employe E. Polenz, and


That Employe Polenz and all others affected shall now be reimbursed for any and all wage loss sustained retroactive to March 23, 1944.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of February 6, 1945, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
