STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:
(a) The carrier violated, and continues to violate, the rules of the Clerks' Agreement when it declined and continues to decline to reclassify to Train Clerk, and to compensate at rate of $6.61 per day, Joseph Dixon, classified as Yard Clerk, rate $6.25 per day, West Oakland, California.
(b) The carrier violated, and continues to violate, the rules of the Clerks' Agreement when it declined and continues to decline to reclassify to Train Clerk, and to compensate at rate of $6.61 per day, Julius Evans, classified as Yard Clerk, rate $6.25 per day, West Oakland, California.
(c) Mr. Joseph Dixon be reclassified as Train Clerk and compensated at rate of $5.81 per day from May 27, 1941 (date claim filed by Division Chairman with Division Superintendent), to and including August 31, 1941; $6.53 per day from September 1 1941, to November 30, 1941, and $6.61 per day thereafter until he vacated the position to enter the armed forces in Novomber, 1942.
(d) Julius Evans be reclassified as Train Clerk and compensated at rate of $6.61 per day, effective on or about April 16, 1943.
That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and
That no hearing thereon has been held, and under date of March 6, 1945, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
