PARTIES TO DISPUTE:
BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
SOUTHERN PACIFIC COMPANY (PACIFIC LINES)
STATEMENT OF CLAIM:
Claim of the System Committee of the Brotherhood that:
(a) The carrier has violated and continues to violate the rules of our
current agreement when it declined and continues to decline to
reclassify and re-rate position now held by Mr. Walter McCarvey,
Yard-Freight Clerk, rate $6.18 per day, Martinez, California, to
Demurrage Clerk, rate $6.84 per day.
(b) Mr. Walter McGarvey's position be reclassified to Demurrage
Clerk and paid rate of $6.84 per day, retroactive to April 2, 1943,
date claim was filed by Division Chairman of the Brotherhood
with Division Superintendent of the carrier.
NOTE: Rates named in Items (a) and (b) above subject to adjustment in consonance with national wage increase award dated
January 17, 1944.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by complainant party; and
That no hearing thereon has been held, and under date of March 6, 1945,
the complainant party addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case, which request is
hereby granted.

Case dismissed.
