PARTIES TO DISPUTE:





STATEMENT OF CLAIM: * * * for and in behalf of Mr. F. T. Johnson who was formerly employed by The Pullman Company as a porter operating out of the Philadelphia, Pennsylvania District. Because The Pullman Company did, under date of August 9, 1943, discharge Mr. F. T. Johnson from his position as a porter in the Philadelphia District on charges unproved; which action was unjust, unreasonable and in abuse of the company's discretion. And further, because this unreasonable and unjust action was taken on charges which had been placed against Mr. Johnson previously and penalty was previously exacted. And further, for Mr. Johnson to be restored to his former position as a porter in the Philadelphia, Pennsylvania District and for him to be compensated for all time lost as a result of having been unjustly discharged.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of March 16, 1945, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.


AWARD Case dismissed.
