BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that the carrier violated the Clerks' Agreement:
(a) When on July 18, 1943, August 1 1943 and February 18, 1944, it established positions designated as Assistant Ticket Clerks at daily rates of pay.
(b) That carrier be required to reclassify said positions as Ticket Clerks and apply the proper monthly rate, and
(c) That Employes F. Farris V. D. Griggs and B. E. Miller, present incumbents of positions involved and other employes who may have been affected by these violations be compensated for wage loss suffered thereby.
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:
That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and
That hearing thereon has been held and concluded. Under date of March 30, 1945, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.
