FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that: 1. The Carrier violated the provisions of Rule 32 when it refused to pay Clerk, James Carbone at the rate pf $51.25 per week, for April 27th, 28th and 29th, 1944, the days he was assigned to a higher rated position, and 2. That Clerk James Carbone shall be paid the difference between his regular assigned rate of $44.12 per week and $51.52 per week while assigned to the Cashier's position April 27th, 28th and 29th, 1944.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of April 11 1945 . the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
