PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: I. Claim of the Terminal Board of Adjustment, Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes, that the Carrier violated the Clerks' Agreement when it failed to fill the Per Diem Clerk position, a continuous operation position, in the CD Yard Office District on September 2, 3 and 4, 1944.

2. That the Carrier now be required to reimburse the senior employe available on each of the above dates for wage losses suffered account of the Carrier's action in failing to comply with the rules of the Working Agreement.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date, of May 21, 1945, the complainant party addressed a formal communication to he Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
