BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:
I. The Carrier violated Regulations 6-A-I and 7:A-I when it arbitrarily removed Clerk W. J. Francis from his assigned position at Jamaica, N. Y., June 9th, 1943, held him out of service without cause and refused him the opportunity of a trial, hearing or investigation, as requested by him and his local representative, and
2. That Clerk W. J. Francis shall be restored to his position at Jamaica, N. Y., Symbol No. F-5, rate $171.60 per month (Rate $189.95 after December 27, 1943), and
3. That Clerk W. J. Francis shall be paid the difference between the rate ~f the position at Jamaica, N. Y., and the rate of the position at Long Island City, N. Y. (including overtime pay), retroactive to June 26th, 1943 (See Exhibit ., for variation in dates).
That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and
That no hearing thereon has been held, and under date of May 31, 1945, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted
