STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers, Southern Pacific Company, Pacific Lines, that the occupant of position of Agent, Deming, Rio Grande Division, be compensated for each Sunday and Holiday that he performed service, January 4, 1937, to March 10, 1941, based upon the pro rata daily rate of each calendar month in arriving at such pro rata daily rate.
FINDINGS: The Third Division of the Adjustment Board, upon the whole record and all-the evidence, finds and holds:
That the Carrier and the Employes involved in this dispute are respectively Carrier and Employe within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and
That under date of June 20, 1945, the Petitioner addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this dispute, which request is hereby granted.
