STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes on the New York, New Haven & Hartford Railroad:


1. That the Management violated and continues to violate the National Wage Settlement of January 17, 1944 in applying the increases there provided to inexperienced clerks under the prior Agreement (see Exhibit No. 1) and Rule 10 of present agreement.


2. That employes involved in or affected by the above violation be compensated for all losses sustained.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of July 23, 1945, the complainant party addressed a formal communication to the secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
