PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,

FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that the Carrier violates the .rules of the Clerks' Agreement when it compensated L. W. Connole, Rate and Reconsignment Clerk rated $263.40 per month, Hammond, Indiana at pro rata rate for service performed on January 1, 1944, a legal holiday, and January 10th, 1944, his assigned rest day, and


1. That Carrier shall now compensate employe Connole at rate of time and one-half for service performed on January 1, 1944 and all subsequent holidays worked, and


2. That carrier shall now compensate employe Connole at rate of time and one-half for service performed on January 10, 1944 his assigned rest day and all subsequent rest days worked.


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:


That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934:


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;


That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That hearing thereon has been held but not concluded. Under date of September 7, 1945, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.




Case dismissed.
