. STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:


(a) The Carrier violated the Clerks' Agreement at Donna, Texas, by calling the Agent to sell tickets for Train 116 on Sundays and holidays. only. Also .


(b) Claim that the General Clerk be paid eight (8) hours, at the rate of time and one-half, for each of the following Sundays: March 26; April 2, 9, 16 23 30; May 7 14, 21, 28; June 4, 1944 and all subsequent Sundays and holidays during the agreement violation.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of September 8, 1945, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
