PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,

FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES






STATEMENT OF CLAIM: Claim of the General Committee of the

Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes on the Missouri Pacific Railroad, that the Carrier violated the Clerks' Agreement:


1. When, on Thursday, November 23rd and Friday, November 24th, 1944, it failed and refused to permit the senior qualified Ticket Clerk, Mr. E. G. Herring at Little Rock, Arkansas, to perform authorized overtime work in the making of furlough tickets, and instead directed a junior Ticket Clerk, Mr. R. B. Kelley on November 23rd and Mr. F. O. Weed on November 24th, to perform the work, and disregarded the seniority rights of the senior Ticket Clerk, Mr. E. G. Herring;


2. Clerk E. G. Herring shall be compensated for five hours and thirty minutes at the rate of time and one half on November 23rd, amount $8.41, and for six hours on November 24th, at the rate of time and one half, or $9.18, total $17.59, account Carrier's action in violation of the Agreement.


FINDINGS: The Third Division of the Adjustment Board Finds:

That the dispute was certified to the Third Division of the Adjustment
Board ex parte by complainant party; and

That no hearing thereon has been held, and under date of September 7,

1945, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
