PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES



STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that the carrier shall now remove the name of J. E. Zinsmeister from the Kent Division Roster for the year 1945 and thereafter account Mr. Zinsmeister no longer being entitled to retain and accumulate seniority under the provisions of the Clerks' Agreement dated December 1, 1943, and


That the names of other employes holding positions in the Police Department shall likewise be removed from seniority rosters established under the Clerks' Agreement with the exception of two employes now in the armed forces of the United States Government.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of November 28, 1945, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of the case, which request is hereby granted.




Case dismissed.
