BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that the Carrier violates the rules of the Clerks Agreement at Piers 20 and 21, N. R. (Duane Street), New York, New York when it refuses to compensate Watchmen M. Seltzer, H. Hammond, F. Lermo, A. Burselem, S. Jacobs and all other watchmen at Duane Street, New York at rate of time and one-half for time worked in excess of eight hours on any day, also for time worked on Sundays and the specified legal holidays, and
That Carrier shall now compensate the watchmen at rate of time and one-half for service in excess of eight hours on any day and also Sundays and Holidays retroactive to March 1, 1944.
That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and
That no hearing thereon has been held, and under date of November 23, 1946, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of the case, which request is hereby granted.
