PARTIES TO DISPUTE:





STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on Reading Company, that William E. Brewster, the regularly assigned first trick, and Glenn P. Turley, the regularly assigned third trick towermen in the Shippensburg, "SX" tower, Pa, who were required to work on their assigned relief days to 1941, 1942 and 1943 because a relief employe was not furnished by the Carrier on such relief days, were entitled under the Provisions of Rule 26 of the telegraphers' agreement to be paid at time and one half rate, and shall be paid the difference between the pro rata rate at which they were paid and the time and one-half rate for each of these they were required to work on their relief days.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant ,party; and


That no hearing thereon has been held, and under date of December 4, 1946, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of the case, which request is hereby granted.




Case dismissed.
