PARTIES TO DISPUTE:





STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on The Pennsylvania Railroad, that (a) the Carrier is violating the telegraphers' agreement by discontinuing the third trick block operator position daily at "Weigh Scales;" Wilkes Barre Division, and making it a Block Limit Station and during the hours of this closed trick to issue train orders and Form K clearance cards direct to train and engine service employes at this point by means of the telephone through block operators at another location; and (b) that so long as the Carrier requires the performance of such telephone service during the hours of the former third trick block operator position at "Weigh Scales" it shall be performed by an employe under the telegraphers agreement.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and


That no hearing thereon has been held, and under date of November 29, 1946, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of the case, which request is hereby granted.




Case dismissed.
