PARTIES TO DISPUTE:

 BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES

STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:


(a) The Carrier violated the Clerks' Agreement by deducting four (4) hours pay from the January, 1945, earnings, of Clerk A. B. Muller on the grounds that he received more vacation in 1944 than he was entitled to; also


(b) Claim that the Carrier be required to reimburse Mr. Muller for the four (4) hours pay that was deducted from his earnings.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and


That no hearing thereon has been held, and under date of December 7, 1945, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of the case, which request is hereby granted.




Case dismissed.
