PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT. HANDLERS, EXPRESS AND STATION EMPLOYES



STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:


(a) The Carrier violated the Clerks' Agreement at Laredo, Texas in November 1944 when it abolished the position of Asst. Chief Clerk, rate $208.36, and concurrently therewith created in lieu thereof a position of Bill Clerk, rate $1.88.76, to perform relatively the same class of work; also


(b) Claim that the Carrier be required to restore the rate of $208.36 retroactive to November 16, 1944; and


(c) Claim that all employes involved in or affected by this Agreement violation be compensated for all losses sustained.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and


That no hearing thereon has been held, and under date of December 7, 1945 the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of the case, which request is hereby granted.




Case dismissed.
