STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that
the Carrier violated the Clerk's Agreement:
1. When on December 9, 1943, John F. Arnold, platform trucker,
was
removed from
the service and not permitted to return to duty
until April 17, 1944.
2. That Mr. Arnold be compensated for all monetary loss sustained by him by reason of the Carrier's action from December 9, 1943
to April 16, 1944 inclusive.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by complainant party; and
That no hearing thereon has been held, and under date of December 13,
1945 the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case,
which request
is hereby granted.
AWARD
Case dismissed.
