PARTIES TO DISPUTE:

BROTHERHOOD OF RAILROAD SIGNALMEN OF AMERICA



STATEMENT OF CLAIM: (a) Claim that the Carrier violated the provisions of the current Signalmen's Agreement starting in September, 1943, at Broad Street Station, Philadelphia, Pennsylvania, when it had work covered by the scope of tat agreement, consisting of renewing conduits, installing circuit wiring and other work in connection with Train Ready Light System, turned over to a contractor whose workmen held no seniority rights to such work under the provisions of the Signalmen's Agreement.


(b) Claim that these positions filled by the contractor's workmen should have been bulletined and assigned to the senior applicants from the Philadelphia Terminal Division Seniority Roster and the work performed in accordance with the provisions of the current Signalmen's Agreement.


(c) Claim that the successful applicants, as determined by claim (b), be paid such amounts as they respectively woud have earned had they been so assigned to perform this work covered by the Signalmen's Agreement and which was performed by the contractor's workmen.




That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held and under date of March 8, 1946, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing the case, which request is hereby granted.




    Case dismissed.
