STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on The Delaware, Lackawanna & Western Railroad Company that the agent at Danville, Pennsylvania, shall be paid a call on each day, October 10, 1944, through April 21, 1945, on which days the Carrier required the train crew of train SN-37 to report from Danville its arrival, and transmit car reports of record at Rupert, Pennsylvania (adjoining station), direct to the train dispatcher by means of the telephone, in violation of the terms of the Telegraphers' Agreement, while the agent at Danville was not on duty.


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21,1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; '


That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That hearing thereon has been held and concluded. Under date of March 11, 1946, the parties jointly advised the Secretary of the Third Division of their desire to withdraw this case from further consideration by the Division, which request is hereby granted.
