STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that


(1) The Carrier violated Agreement Rules when, on March 13th, 1944, it removed work assigned to AAR Bill Clerk Positions Nos. 9 and 11, of the "Car Department Clerks-Hudson Shops" seniority district, located on the line of the Chicago, Saint Paul, Minneapolis and Omaha Railway Company at Hudson Shops, Wisconsin, to the Chicago and Northwestern Railway Company's Fortieth Street Shops, Chicago, Illinois, assigning incumbents of such positions by bulletin of March 2, 1944, to move with their work, and that


(2) The Carrier shall now be required to return the work removed and the positions to Hudson Shops and restore clerical employes affected thereby to such positions, and that


(3) Employes affected by such removal of work shall be reimbursed for all wage and other monetary losses sustained from March 13, 1944, until such work is again returned to Hudson Shops and restored to former incumbents.


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the, dispute involved herein;

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That this dispute was handled in the usual manner and deadlocked. The dispute was certified to the Mediation Board who appointed Henry J. Tilford

as referee to sit with the Division and make an award. The referee wrote a proposed award, but before it was acted upon the parties jointly notified the Division on Feruary 13, 1946, of their desire to withdraw the case, which request is hereby granted.



    Case dismissed.
