BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes that the Carrier violated the Clerks' Agreement:
1. When it failed and refused to properly compensate C. S. Stepnick, Clerk in the Joint Facility Accountant Office at St. Paul, Minnesota, for work performed on position known as J-14, since July 14, 1944.
2. That Clerk, C. S. Stepnick shall be compensated at the rate of $8.94 per day instead of $7.93 per day which he was paid or a difference of $1.01 per day, for each day required to perform the higher rated work assigned to position J-14, retroactive to July 14, 1944.
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:
That the carrier and the employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and
That hearing thereon has been held and concluded. Under dates of July 17 and July 25, 1946, the respective parties advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.
