STATEMENT OF CLAIM: * * * for and in behalf of H. S. Warner who Is now, and for some years past has been, employed by The Pullman Company as a porter operating out of the district of New York, New Yoric.
Because The Pullman Company did, under date of July 7, 1945, take disciplinary action against Porter Warner by giving him an actual suspension of thirty days on charges unproved; which action was unjust, unreasonable, arbitrary and in abuse of the Company's discretion.
And further, for the record of Porter Warner to be cleared of the charge in the Instant case and for him to be reimbursed for all pay lost as a result of his having been subjected to this unjust actioi_
That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and
That hearing thereon has been held and concluded, and under date of July 30, 1946 the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
