JOINT COUNCIL DINING CAR EMPLOYES, LOCAL 465



STATEMENT OF CLAIM:, Claim of the Joint Council Dining Car Employes Union, Local 465, on the property of the Union Pacific Railroad Company, for and in behalf of Clement A. Hunter that he be reinstated with full seniority rights and compensated for time lost.


OPINION OF BOARD: Based on the facts and circumstances of this case, the Carrier's continuing offer to reinstate claimant with seniority rights unimpaired and without compensation for time lost should be accepted.


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the carrier and the employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jursidiction over the dispute involved herein; and


That claimant be reinstated with seniority rights unimpaired, but without pay for time out of service.




    Claim disposed of in accordance with Opinion and Findings.
