STATEMENT OF CLAIM: (a) Claim of the American Train Dispatchers Association that the Missouri-Kansas-Texas Lines failed to comply with the provisions of Article IV (c) of the current agreement (effective July 16, 1937) between the Carrier and the American Train Dispatchers Association when it failed and refused to pay Train Dispatcher N. G. Jones, of the Parsons, Kansas office, one minimum day's pay trick train dispatcher rate for one hour's work performed on May 13, 1944 which service he was called to perform outside his regular tour of duty.
(b) The Missouri-Kansas-Texas Lines shall now pay Train Dispatcher N. G. Jones the difference between one hour at overtime rate, which he was paid, and a full minimum day's day, prorata rate, trick train dispatchers rate to which he was entitled under the provisions of Article IV (c).
That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and
That no hearing thereon has been held and under date of November 12, 1946 the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
