PARTIES TO DISPUTE:

FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES

STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employees that,


(1) The Carrier violated and continues to violate the Clerks' Agreement of September 1, 1944 when it failed to assign and continues to refuse to assign Loss and Damage Investigator Mrs. Edith Brannon, salary $206.96 per month to a similar position of Loss and Damage Investigator, salary $238.96 per month as covered by Bulletin No. 54 of May 7, 1945, and that,


(2) Loss and Damage Investigator Mrs. Edith Brannon shall now be awarded the position, given reasonable opportunity to qualify, as provided for by the rules of the Agreement-if she is not already fully qualifiedand shall be paid the difference between salary of $238.96 per month and $206.96 per month, retroactive to May 12, 1945, date she should have been awarded the position.


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:


That the carrier and the employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;


That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That hearing thereon has been held and concluded. Under date of November 22, 1946, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, whiich request is hereby granted.
