PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
CENTRAL OF GEORGIA RAILWAY COMPANY

STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes that,


(1) The Carrier violated the Clerks' Agreement of September 1, 1944, when, effective November 1, 1945, it appointed Mr. J. T. Parkins, a nonemploye, to the position of Chief Clerk-Passenger Traffic Manager's Office, Savannh, Georgia, and that therefore,


(2) Mr. Louis Dismer, the senior, qualified employe of this Seniority District (District 4) shall now be awarded the position of Chief Clerk-Passenger Traffic Manager's Office, Savannah, Georgia, and that,


(3) Mr. Louis Dismer shall be compensated for the difference in wage loss, i. e., the difference between salary of $274.36 per month and $300.00 per monh, this difference being per month, representing the difference between the salary of Chief Rate Clerk, Mr..Dismer's present position and salary of Chief Clerk-Passenger Traffic anager's Office, Savannah, Georgia, retroactive to November 1, 1945.


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:


That the carrier and the employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;


That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That hearing thereon has been held and concluded. Under date of November 22 1946, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.
