PARTIES TO DISPUTE:

FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES

STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway & Steamship Clerks, Freight Handlers, Express and Station Employes that the Carrier is violating the Clerks' Agreement of September :l, 1944 and that, therefore,


(1) The position presently occupied by Clerk Robert L. Wilson, Car Accountant's Office, Savannah, Ga., should be compensated at $225.96 per month instead of $184.96 per month (plus adjustments of $32.64 per month as per Agreement of April 3-4, 1946 and $5.10 per month as per Agreement of May 25, 1946, total of $37.74 per month above specified rate), and that,


(2) Clerk Robert L. Wilson shall now be compensated for the difference between proper salary of $225.96 per month and the salary he has actually received, $184.96 per month, this difference being $40.40 per month, retroactive to February 16, 1945, and that,


(3) Clerk Robert L. Wilson shall retain this position as result of institution of proper salary as per Rule 16.


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:


That the carrier and the employe involved in this dispute are respectively carriier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;


That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That hearing thereon has been held but not concluded. Under date of November 29, 1946, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case from further consideration by the Division, which request is hereby granted.
