STATEMENT OF CLAIM:
Claim of the System Committee of the Brotherhood of Railway Clerks that W. F. Keough, Chief Clerk, Stockton Yard,
California, was senior qualified regular clerk available and should have been
called for the performance of work on the following positions at Stockton
Yard on the dates indicated, all in 1943.
Train Desk Clerk 12:01 A. M. Jan. 3, 4, & 28.
Car Career 12:01 A. M. Feb. 2.
Interchange Clerk 12:01 A. M. Feb. 10 to 13 both inclusive.
Train Desk Clerk 12:01 A. M. Feb. 22, 23, 26 & 28.
Train Desk Clerk 12:01 A. M. Mar. 26, 27, 28, 31.
Train Desk Clerk 12:01 A. M. Apr. 2 & 7.
Train Desk Clerk 12:01 A. M. Apr. 9 to 30, both inclusive.
Train Desk Clerk 12:01 A. M. May 1 to 7, both inclusive, and
May 28, 29, 30, 31.
Train Desk Clerk 12:01 A. M. June 1 to 30, both inclusive.
Train Desk Clerk 12:01 A. M. July 1, 3, 5, 6, 20, 21.
Car Carder 12:01 A. M. July 27, 28 & 29.
Car Carder 12:01 A. M. Aug. 2, 3, 5, 6, 7, 9, 10, 11, 15, .17 & 18.
Car Carder 12:01 A. M. Aug. 21 to 28, both inclusive.
FINDINGS:
The Third Division of the Adjustment Board, after giving
the parties to this dispute due notice of hearing thereon and upon the whole
record and all the evidence, finds and holds:
That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as
approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board jointly by the parties; and
That hearing thereon has been held and concluded, and under date of
January 11, 1947 the parties addressed a formal communication to the Sec-

retary of the Third Division requesting withdrawal of this case, which
request is hereby granted.
AWARD
Case dismissed.
