STATEMENT OF CLAIM: Claim of the System Committee that Checker B. Bennerson and all other employes affected (including foremen, clerks, checkers, crane engineers, riggers, coopers and messengers, machine operators, laborers and sweepers as listed in appendix) be re-imbursed for loss of earnings on October 10th, 11th, 12th, 13th, 15th and 16th, 1945 account of improper abolishment of positions by the Carrier at Dock No. 11, Jersey City, New Jersey in violation of the rules of the Clerk's Agreement. FINDINGS: The Third Division of the Adjustment Board finds:
That this dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and
That no hearing thereon has been held, and under date of January 20, 1947, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of the case, which request is hereby granted.
