STATEMENT OF CLAIM:
Claim of the General Committee of the
Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express
and Station Employes on the Missouri Pacific Railroad, that the Carrier
violated the Clerks' Agreement:
1. When, on Sunday, July 4, 1943 and continuing thereafter on
each Sunday and/or involved designated rest day other than
Sunday, as stipulated in claim Statements "A" and "B" made
a part hereof, it failed to compensate its telephone switchboard
operators at Osawatomie, Kansas for service performed by
them in accordance with the provisions of the Clerks' Agreement;
2. That the Carrier be required to compensate each of the claimants, namely, Mrs. Velma Conklin, $284.03; Mrs. E. Haigh,
$289.505; Mrs. A. Laird, $10.82 and Mrs. B. Barrett, $16.29
the amount of difference in pro rata rate which they were paid
and punitive rate which they were entitled to be paid for services
rendered the Carrier under the provisions of Rule 26 of the
Clerks' Agreement.
FINDINGS:
The Third Division of the Adjustment Board finds
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by complainant party; and
That no hearing thereon has been held and under date of March 3, 1947
the complainant party addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Case dismissed.
