PARTIES TO DISPUTE:

BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES

PITTSBURGH & WEST VIRGINIA RAILWAY COMPANY

STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood:


(1) That the Carrier violated agreement in effect by laying off, or furloughing, Labor Foreman Charles Reis of the Steam and Electrical Department and assigning to the performance of the work which he customarily performed, a person who does not come wthin the scope of the Maintenance of Way Agreement and who has no seniority rights in the Stearn and Electrical Department;


(2) That Labor Foreman Charles Reis shall be restored to his position as labor foreman in the Steam and Electrical Department and paid for all time lost, retroactive to May 6, 1946.




That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party. and


That no hearing thereon has been held, and under date of March 20, 1947, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
