STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(a) The Carrier violated the Clerks' Agreement at San Antonio, Texas,
beginning August 1, 1945, when it used a Mail and Baggage Porter, n Sun
days and holidays only, to perform work regularly assigned to and performed
by Messenger Howard Miller on all other days. Also _
(b) Claim that Mr. Miller, or his successors, be paid eight (8) hours at
the rate of time and one-half for each Sunday and holiday subsequent to
August 1, 1945.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by complainant party; and
That no hearing thereon has been held, and under date of March 29,
1947, the complainant party addressed a formal communication to the

Secretary of the Third Division requesting withdrawal of this case, which
request is hereby granted.
AWARD
Case dismissed.
