BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES

CHICAGO, ROCK ISLAND & PACIFIC RAILWAY COMPANY

STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood:


(1) That the Carrier violated agreement in effect by calling Gene Claude, junior section laborer at Clarion, Iowa, for service on Sunday, August 19, 1945, instead of calling for such service senior Section Laborer George Penn;


(2) That George Penn shall be paid for ten (10) hours at time and onehalf rate on Sunday, August 19, 1945.




That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of May 1, 1947, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




    Case dismissed.
