STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood:
(1) That under the application of Article XXV, Rule 1, of agreement in effect, the Maintenance of Way blacksmith shall be paid the rate applicable to Mechanical Department blacksmith, which is six cents (6¢) per hour above the rate applicable to a Maintenance of Way blacksmith, for all of the time that he performs a class of service recognized to be work in the Mechanical Department;
(2) That. Maintenance of Way Blacksmith Herman Voight, who has devoted approximately four hours per day to blacksmith's work in the Mechanical Department, shall be paid the difference between what he received at the rate applicable to Maintenance of Way blacksmiths and that which he should have received at the rate applicable to Mechanic Department blacksmiths, or six cents (60) per hour over and above rate paid, for four hours per day, retroactive to May 1, 1940.
That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and
That no hearing thereon has been held, and under date of May 27, 1947, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
