PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES THE ERIE RAILROAD COMPANY


STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that the Carrier violates the Clerks' Agreement:


(1) When it requires and permits the Freight Agent at Barberton, Ohio, an employe not covered by any agreement to perform more than four (4) hours clerical work daily, and


(2) That Carrier shall now be required to establish position of ClerkTypist, Barberton, Ohio and fill same in accordance with the provisions of the Clerks' Agreement, and


(3) That Carrier shall reimburse the successful applicant and all other employes affected for any and all wage loss sustained retroactive to December 16, 1945.




That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held ,and under date of May 29, 1947, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
