STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood:
(1) That the Carrier violated agreement in effect by contracting certain work of remodeling an making repairs to the Gulf Terminal Station, Mobile, Alabama;
(2) That J. L. Crabtree, Assistant B&B Foreman, shall be paid the difference between what he received as assistant B&B foreman and that which he should have received as B&B foreman; that M. P. Pannal, First Class B&B Mechanic, shall be paid the difference between what he received as first class B&B mechanic and that which he should have received as paint gang foreman; that L. H. Roberts, Second Class B&B Mechanic, shall be paid the difference between what he received as second class B&B mechanic and that which he should have received as first class B&B mechanic; and that H. A. Weeks and J. 0. Wygul, Road Carpenter Helpers, shall be paid the difference between what they received as road carpenter helpers and that which they should have received as first class B&B mechanics, during the period the outside contractor was engaged in the performance of this work from on or about March 28, 1946, until it is completed.
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:
That the Carrier and the Employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment Board jointly by the parties involved; and
That hearing thereon has been held and concluded. Under date of December 4, 1947, the parties jointly advised the Secretary of the Third Division of their desire to withdraw this case from further consideration by the Division, which request is hereby granted.
