BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES

STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes that:

(1) The carrier violated the Clerks' Agreement by failing and refusing to apply the provisions of Rule 81 of current agreement to the position of Tariff File Clerk in the office of the General Traffic Manager, Chicago, and

(2) The carrier violated the Clerks' Agreement by failing and refusing to apply the provisions of Rule 81 of current agreement to the position of Junior Correspondence Clerk in the office of General Traffic Manager, Chicago, and

(3) The carrier is violating the Clerks' Agreement by failing to apply the provisions of Rule 81 of current agreement to any other clerical position in the department now paid a monthly rate of less than $190.52 per month, and

(4) All sub-standard rates of pay for clerical employes in the office of General Traffic Manager be corrected and that all employes involved in or affected by the above agreement violations be compensated for all wage losses sustained retroactive to November 7, 1946.

FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment

That no hearing thereon has been held, and under date of January 7, 1948, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
