STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on the New York Central Railroad, Buffalo and East, that
(a) The Carrier violated Rule 32-(a) of the Telegraphers' Agreement when said carrier refused to grant a hearing which was requested within ten days following its advice to Mr. Victor E. Trick that he had been disciplined to the extent of an assessment against his personal record of a ten (10) day record suspension, and
(b) In consequence of said violation Mr. Trick's personal record shall be cleared of said ten (10 day record suspension.)
That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and
That no hearing thereon has been held, and under date of April 13, 1948, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
